Effective August 2024, mean sellers can't automatically pay buyer agents via the MLS; instead, buyers must now sign written agreements with their agents before house hunting, negotiating fees directly with their agent, increasing transparency, and shifting cost responsibility, though sellers/listing agents can still offer buyer agent compensation off-MLS.
Here's a breakdown of what changed for buyers:
- Written Agreements are Mandatory: You must have a signed buyer-broker agreement with your agent before they show you homes, clearly stating their compensation (fee).
- No More Automatic MLS Offers: Listing agents can no longer advertise buyer agent commissions on the MLS.
- Negotiate Your Fee: You and your agent agree on their payment, which could be a flat fee, hourly rate, or a percentage.
- Sellers Can Still Offer Concessions: Sellers can still offer to help pay for buyer's agent fees (or other costs like repairs/loan fees) but must disclose it in writing off-MLS (via email, text, etc.).
- Greater Transparency: The goal is for buyers to know exactly what they're paying for their agent's services, unlike the old system where it was hidden in the home's price.
In Simple Terms: You now hire your buyer's agent and pay them directly, similar to how you'd hire a lawyer, but the seller can still give you money (a concession) to cover that cost if you negotiate for it.
